Напрями трансформації державної митної справи як складової зовнішньоекономічної діяльності

Abstract

У статі розглянуто провадження державної митної справи в Україні. Визначено основні проблемні питання здійснення митної справи в Україні, серед них виокремлено внутрішні, вирішення яких знаходиться в компетенції Державної митної служби України (управлінські та технічні), та зовнішні, вирішення яких залежить також від інших органів державної влади (правові та функціональні). Обґрунтовано пріоритетні напрями модернізації митної справи в Україні, що відповідають сучасним запитам міжнародного простору в напрямі економічних відносин, зокрема: рекомбінація функцій митних органів, гармонізація митного законодавства відповідно до Міжнародної конвенції про спрощення митних процедур та Рамкових стандартах безпеки; максимальна автоматизація роботи митних процедур, яка передбачає застосування сучасного програмного й апаратного забезпечення та оптимізацію процесу електронного декларування; боротьба з корупцією. The article outlines the directions of transformation of state customs as a component of foreign economic activity. It is determined that the customs business is a component of the system of state regulation in the sphere of foreign economic activity and the mechanism of customs policy implementation; the essential elements of the customs business are the procedure for moving goods and vehicles across the customs border of Ukraine, realizing their customs control and customs clearance, making customs payments and combating smuggling and violation of customs rules. It is noted that effective customs management is accompanied by strengthening of certain relations and increasing the efficiency of implementation of each element of customs. The main problematic issues of customs administration in Ukraine are distinguished, among which the internal ones, which are within the competence of the State Customs Service of Ukraine (administrative and technical), and the external ones, which also depend on other state authorities (legal and functional), are highlighted. Priority directions of customs modernization in Ukraine, which meet the contemporary requirements of i nternational space in the direction of economic relations, are substantiated, in particular: recombination of functions of customs authorities (transition from the customs service as a purely fiscal authority to the controlling body, the basis of which is to ensure compliance with the customs legislation of Ukraine cases), harmonization of customs legislation in accordance with the International Convention on the Simplification of Customs Procedures and the Framework Security Standards; maximum automation of customs procedures, which involves the use of modern software and hardware and optimization of the process of electronic declaration (implementation of the concept of "single window", the use of the latest technical means of customs control); the fight against corruption; minimization of shadow foreign trade flows. Customs modernization elements are proposed that will simplify customs control procedures, which will reduce administrative pressure on honest members of the FEA and, at the same time, facilitate the cessation or elimination of illegal goods flows into the legal international trade.
