Дисертація на здобуття наукового ступеня кандидата юридичних наук зі спеціальності 12.00.03 - цивільне право і цивільний процес; сімейне право; міжнародне приватне право. - Київський національний університет імені Тараса Шевченка. - Київ, 2011. Дисертація присвячена комплексному аналізу наказного провадження в цивільному процесі України. Розкрито особливості наказного провадження та судового наказу як самостійного судового акта, зміст вимог, за якими може бути видано судовий наказ, а також підстави для відмови в прийнятті заяви про відкриття наказного провадження. Проаналізовано процедуру видачі судового наказу, повідомлення боржника про видачу судового наказу та скасування судового наказу за заявою боржника. Констатується, що законодавча регламентація даного інституту далека від досконалості. У зв'язку з цим у дисертації обґрунтовані пропозиції щодо внесення змін та доповнень до чинного ЦПК України, спрямовані на усунення суперечностей між окремим нормами, які стосуються наказного провадження, та його узгодження з іншими процесуальними інститутами. SUMMARY Verbicka M.V. Ordering proceedings in the civil procedure of Ukraine. - Manuscript. The dissertation is dedicated to the complex analysis of the ordering proceedings in the civil procedure of Ukraine. The issues concerning setting up the institution of the ordering proceedings and its development have been dealt with, the nature of the procedural legal process and the notion of "ordering proceedings" have been defined. For instance, it has been emphasized that appealing to the court concerning issuing the judicial order, even if according to the demands of the suer the judicial order can be issued, mustn't be considered as an obligatory procedure. The concept of alternativeness for ordering proceedings would allow to secure the fulfillment of principles of civil legal proceedings at the higher level, the principle of remaining non-mandatory, in particular. The content of the circumstances under which the court can apply ordering proceedings has been revealed. The peculiarities of issuing legal order have been analyzed together with the demands envisaged in the Code of Civil Procedure of Ukraine as those according to which a legal order is issued. The list of demands that can be taken into consideration in the course of ordering proceedings has been supplemented with other related items and submitted in this work. The procedural peculiarities about the realization of the debtor's right for submitting an application concerning forensic order annulment have been investigated. The research paper specifies that submitting the application about issuing the forensic order is the grounds for breaking the course of prescription. But the reversion of the application about issuing the forensic order as well as its annulment do not break the order of prescription. It has been figured out that legislative regulation of the given institution is far from being perfect. In relation to this, the dissertation substantiates some proposals concerning introduction of the changes and attachments to the valid C.C.P. of Ukraine which are directed to eliminate contradictions and inconsistencies between certain norms and standards related to the ordering proceedings and their coordination with other procedural institutions. The proposals concerning law application practices have been advanced. It has been offered to modify slightly the rules that regulate the procedure of opening the ordering proceedings. For instance, it has been pointed out at the necessity to extend the period of resolution about the award concerning opening the ordering proceedings imposed by the judge up to three days, and to reduce the period of issuing the forensic order up to one day. It's been offered to supplement the list of claims according to which the forensic order can be issued with one more claim which is based on the agreement submitted in the written form, so long as judicial practice proved the efficiency of use of the ordering proceedings concerning those claims which are grounded on credit agreements, bank deposit agreements, and agreements about concession of services, etc. It has also been offered to introduce the regulation into the chapter of the C.C.P. of Ukraine concerning ordering proceedings about issuing the writ of execution on recovering payment of forensic charge from the debtor on the grounds of forensic order in case of collector's exemption from the forensic charge. The necessity for reconsideration of the rule stating that in case of the debtor's absence at the given address, where the copy of the judicial order has been sent, the day of its receiving by the debtor should be considered the day when the mark verifying the debtor's absence was stamped in the postal notice, has been proved. The necessity for annulment of such forensic order by the court has been grounded. The possibility of plurality of litigants in the ordering proceedings has been mentioned, in particular, the expediency of participation on the debtor's side on the conditions of availability of shared responsibility of several debtors has been proved. The procedure of consideration of the statement of claim by the court about the annulment of the forensic order during the open juridical hearing has been investigated as well as the court's mandate which were allotted on it in the result of such consideration. Proceeding from the tasks of the civil legal procedure and guided by the principles of the civil procedural law, the necessity of providing the possibility of indexation of the awarded monetary amount and applying rules of indexation in the ordering proceedings of the C.C.P. of Ukraine has been argued. This will facilitate strengthening the procedural guarantees for the suer in case of debtor's event of default.
