Abstract: Досліджено закономірності становлення і розвитку системи фінансового забезпечення функціонування
університетів як центрального елемента системи закладів вищої освіти університетського рівня. Фінансування університетів розглядається, як елемент забезпечення їх функціонування і в розрізі двох його форм: публічного та приватного. Проаналізовано зарубіжний та український досвід правового регулювання фінансування
університетів, зокрема започатковані в 2020 р. новели фінансування вітчизняних закладів вищої освіти університетського рівня. The article is devoted to the study of patterns of formation and development of the system of financial support
for the functioning of universities as a central element of the system of higher education institutions at the university
level and to determine on this basis the relevant tendencies and problems.
It is noted that the issue of retaining universities, providing their financial and logistical needs has been urgent
since their emergence as a public institute, and it remains so today. In particular, the relevant issues are characterized in
Ukraine. The principles of public financing of domestic universities have recently undergone significant changes, which
have already started to be implemented since 2020.
In the world, public funding for higher education institutions is through the prism of implementing appropriate
public policy. Public funding for higher education is provided through national and local budgets. World practice has a
diversity of funding models for universities. Based on the analysis, they can be broadly divided into two types, depending
on the source of funding: public (state and municipal) and private. The financial models used in the practice of European
universities take into account the effectiveness of the university’s activities, but they differ depending on the type of
activity of the university, for example, some financial models are used for training and others for research activities.
Regarding Ukraine, there is reason to note the general trends in the development of the countries with economies
in transition, in view of the fact that the government (the state) remains the main source of funding for higher education,
while the decrease of the state budget for financing the education of students is evident. training, development of new
programs and investment in research.
A dramatic change in the mechanism of public funding of Ukrainian universities began in late 2019, when the
Ministry of Education and Science of Ukraine significantly changed the approach to financing higher education. These
changes are envisaged in the Concept of Reforming Financing and Management of Higher Education Institutions.
In general, it should be noted that the search for and development of an effective university funding model
should take into account all the activities of the university and be based on efficiency, transparency and autonomy. This
should, in turn, increase the accountability of all participants in the educational process and enable the use of limited

Abstract: Досліджено права і свободи людини й громадянина в Україні. Визначено роль Національної поліції України

до пріоритетних напрямків та є стратегічною метою діяльності Національної поліції України. Досліджено
нормативно-правові засади діяльності правоохоронного органу. Проаналізовано основні інструменти, які
застосовує Національна поліція України, для недопущення порушень прав громадян. Зазначено, що реформування
системи правоохоронних органів позитивно вплинуло на процес звернень громадян до державних органів за
допомогою. Внесено авторські пропозиції щодо питання покращення взаємодії між правоохоронними органами
та українським суспільством. The article is devoted to the study of human and citizen’s rights and freedoms in Ukraine. The role of the
National Police of Ukraine in the protection of human rights and freedoms has been determined. It is established
that the protection of human rights and freedoms is one of the priority areas and is a strategic goal of the National
Police of Ukraine. Regulatory principles of law enforcement activities were investigated. The main tools used by the
National Police of Ukraine to prevent violations of citizens’ rights are analyzed. It was noted that the reform of the law
enforcement system had a positive impact on the process of appealing to the public authorities for help. The author
proposes to improve cooperation between law enforcement agencies and Ukrainian society.
The effectiveness of the activities of law enforcement agencies is crucial to the protection of the rights and
freedoms of citizens for social development and the formation of a modern rule of law, democratic state, adherence

Abstract: Розкрито тему регулювання правових відносин, що виникають у зв’язку із публічною обіцянкою
винагороди без оголошення конкурсу, викладено проблемні питання, які виникають на практиці у зв’язку із
застосуванням цього правового інституту (зокрема, питання відмежування публічної обіцянки винагороди без
оголошення конкурсу від оголошень, маркетингових акцій; питання точного формулювання обіцянки виплати
винагороди та її форми тощо), окреслено окремі порівняльні аспекти законодавчого регулювання інституту
публічної обіцянки винагороди без оголошення конкурсу України та зарубіжних країн, за результатами чого
запропоновано внести зміни до цивільного законодавства України. I believe it is undeniable that the relationship with the public promise of reward without an noun cement of

without announcement of the competition appeared only with the adoption of the Civil Code of Ukraine on January
16, 2003. To date, issues related to the practical application of this legal institute remain problematic. Often, an noun

certain information or the fulfillment of certain tasks. In view of the foregoing, the question arises stow he the such
an noun cement sentail legal consequences, whet her in all cases they fall with in the scope of the public promises of
remuneration, whether the executor of the assignment can claim remuneration and, if so, in which size. In addition,
there is still no scientific literature in the scientific literature, the subject of which is to compare the legislative
regulation of the Institute of Public Promise of Remuneration with out an noun cing the competition of Ukraine and
foreign сountries.

Abstract: Досліджено право господарського відання в системі речових суб’єктивних цивільних прав. Проаналізовано
нормативно-правове забезпечення права господарського відання в історичній ретроспективі: від першої згадки в
Законі СРСР «Про власність в СРСР» від 6 березня 1990 р. до сучасного періоду розвитку цивілістики. Приділено
особливу увагу питанню змісту права господарського і його співвідношення з іншими речовими правами. The article is devoted to the right of economic management in the system of real subjective civil rights. The
author analyzes the legal support of the right of economic management in historical retrospect i.e. from the first
mention in the Law of the USSR «On Property in the USSR» from March 6, 1990 to the modern period of development
of civilistics. In the article, the author notes that the issue of effective use of state property in modern conditions is
becoming very relevant. Business management is quite young in the subjective subjective civil rights system, but it
still needs further scientific understanding and elaboration of the ways of its evolution, since many foreign states have
completely transformed it or abandoned it altogether. The same thing is for the national legislator to take a principled
position on its further evolution.
The study of the right of economic management in historical retrospect allowed the author to form a position
on changing the attitude of the legislator to this right from full recognition in the civil legislation of the early 90›s to the
transfer to the Economic Code of Ukraine and no mention in the modern Civil Code of Ukraine.
The Law of Ukraine «On Entrepreneurship» stated that «In exercising the right of full economic management, a state-
owned enterprise owns, uses and disposes of the said property at its discretion, committing to it any acts that do not contradict
the current legislation and the charter of the enterprise.» From the above the author concludes that in comparison with the
right of operational management, the subject of management of the state property has much wider powers. Thus, the entity has
all three powers, but they do not need to be equated with ownership. Because the restrictions are still present, they relate to the
disposal of certain types of property that can be implemented only with the consent of the owner.
The author also examines the views of scientists who say that the exercise of economic management rights is
not limited to the public and communal sectors of the economy, because even the private owner can attach the property
created by the entity. On the basis of such researches the author reveals problems when applying the construction of
economic management.
The issue of state liability for the obligations of state-owned commercial enterprises was also reflected in
the article. In particular, it is noted that the state is not responsible for the obligations of state-owned commercial enterprises, except it is provided by law. The author has paid special attention to the issue of the moratorium on the
forced sale of property of state-owned enterprises.
As a general conclusion, the author proposes the right to keep the economic management in the national
legislation, but clearly state the restrictions in the competence of the management of the state commercial enterprise’s
property. The author stands for the position that clearly spells out restrictions on property rights and so clearly defines
the restriction on the right of economic management. Only with a detailed regulation of such restrictions the state
property management entity will be able to carry out its activities effectively.2019-01-01T00:00:00Z
