Abstract

Дисертацію присвячено дослідженню комплексу теоретичних і практичних питань представництва прокуратурою інтересів дітей в цивільному судочинстві. У роботі аналізується стан наукових досліджень проблеми представництва прокуратурою інтересів дітей в цивільному судочинстві, розкривається поняття та сутність представництва прокуратурою інтересів дітей в суді та правового статусу прокурора як представника інтересів дітей в суді. У роботі проаналізовано загальнотеоретичні, історичні та порівняльно-правові аспекти представництва прокуратурою інтересів дітей в цивільному судочинстві. Досліджено виникнення та розвиток інституту представництва прокуратурою інтересів дітей в юридичній науці та законодавстві. Приділено увагу поняттю та сутності представництва прокуратурою інтересів дітей в суді, розглянуто особливості правового статусу прокурора як представника інтересів дітей в суді. Визначено підстави представництва прокуратурою інтересів дітей в суді. Розглянуто форми представництва прокуратурою інтересів дітей в суді. Окремий розділ в роботі присвячено перспективам розвитку інституту представництва прокуратурою інтересів дітей в Україні, у якому розглянуто тенденції та перспективи розвитку інституту представництва в суді інтересів дітей, що не є громадянами України і перспективи запровадження інституту представництва прокуратурою інтересів дітей в системі ювенальної юстиції. Thesis deals with the theoretical and practical issues of representation Prosecutor interests of children in civil proceedings. A separate section is devoted in the development prospects of the institute prosecution representation for children in the Ukraine, where the tendencies and prospects of development of the institution of representation in court interests of children who are not citizens of Ukraine and prospects of introduction of the Prosecutor representation for children in the juvenile justice system.
