Загальна характеристика системи епідеміологічного нагляду в Україні

Abstract

Наукове дослідження присвячено правовому статусу органів влади, які входять до системи епідеміологічного нагляду в Україні. Актуальність теми обумовлена тим, що система органів епідеміологічного нагляду в Україні зазнавала суттєвих змін протягом останніх п’яти років. Визначено поняття епідеміологічного нагляду. Встановлені конкретні заходи, які повинні здійснюватися в порядку епідеміологічного нагляду. Проаналізовані повноваження різних органів державної влади у сфері здійснення епідеміологічного нагляду. Визначені суперечності та прогалини у законодавстві України, яке регулює здійснення епідеміологічного нагляду в Україні. Запропоновані зміни до законодавства, яке встановлює повноваження органів влади у сфері епідеміологічного нагляду. The scientific research is focused on the legal status of the authorities that are part of the epidemiological surveillance system in Ukraine. The urgency of the topic is due to the fact that the system of epidemiological surveillance authorities in Ukraine has undergone significant changes over the past five years.

The concept of epidemiological surveillance has been defined. The author has established specific measures to be carried out in the form of epidemiological surveillance. The powers of various public authorities in the field of epidemiological surveillance have been analyzed. It has been established that the State Service for Food Safety and Consumer Protection and the Ministry of Health of Ukraine have separate powers in the field of epidemiological surveillance. Issues of epidemiological surveillance within the structure of the Ministry of Health of Ukraine fall within the competence of the State Institution “Public Health Center” and the Chief Sanitary Doctor, who is the Deputy Minister of Health of Ukraine.

The author has determined the contradictions and gaps in the legislation of Ukraine, which regulates the implementation of epidemiological surveillance in Ukraine. In particular, the provisions of Law No. 4004 – ХІІ and the Code of Ukraine on Administrative Offenses still enshrine the right of employees of the State Sanitary and Epidemiological Service to bring citizens to administrative liability for violations of sanitary and epidemiological norms. However, the indicated Service has been liquidated. At the same time, no authority has currently the powers to monitor the compliance with sanitary and epidemiological legislation by business entities and to bring guilty officials to administrative liability.

The author has offered amendments to the legislation that establishes the powers of the authorities in the field of epidemiological surveillance. In particular, to give the right to the State Service for Food Safety and Consumer Protection to inspect business entities and bring the perpetrators to administrative liability.
