Правовий статус юридичних клінік в Україні

Abstract

Наукова стаття присвячена проблемам правового статусу юридичних клінік в Україні. Проаналізовано норми законодавчих і підзаконних актів, які регулюють статус юридичних клінік, а також законопроекти. Вивчено праці науковців у галузі права та локальні нормативно-правові акти закладів вищої освіти, у складі яких створено юридичні клініки. Зроблено висновок, що зараз особливості створення і діяльності юридичної клініки встановлено лише на рівні підзаконних актів. Правовий статус юридичної клініки визначено як сукупність завдань самої клініки, прав і обов’язків її працівників, які визначені засновником для здійснення діяльності у сфері права. Запропоновано власне визначення юридичної клініки. Правові засади діяльності юридичної клініки запропоновано закріпити в Законі України «Про безоплатну правову допомогу». The paper is devoted to the problems of the legal status of law clinics in Ukraine. The norms of legislative and by-laws that regulate the status of law clinics are analyzed. The works of scientists in the field of law and local regulatory legal acts of institutions of higher education, which include law clinics, have been studied. It was concluded that the specifics of the creation and operation of law clinics are established only at the level of by-laws. The legal status of law clinics is defined as a set of tasks of the clinic itself, the rights and obligations of its employees, which are established by the founder to carry out activities in the field of law. The definition of a legal clinic is proposed. It is offered to consolidate the legal basis for the activity of a law clinic in the Law of Ukraine On Free Legal Aid.

The specifics of the creation and operation of law clinics, their staffing, head appointment have been established. The directions of activity of law clinics are analyzed. The functions of law clinics are to provide legal assistance to citizens of Ukraine and disseminate legal information. The law clinic serves as a practice base for students of legal specialties.

Own definition of a legal clinic is proposed. A law clinic is a structural unit of an institution of higher education of the III-IV level of accreditation, which trains specialists in the specialties Jurisprudence, Law Enforcement. It is created to obtain practical work experience for students of legal specialties and provide free legal assistance to socially vulnerable groups of the population.

It is proposed to consolidate the legal basis for the activity of a law clinic in the Law of Ukraine On Free Legal Aid. The law clinic should have the status of a separate unit that is subordinated to the institution of higher education and not to the faculty or department. The appointment of the head of a law clinic should take place on the proposal of the dean of the law faculty or the head of the department of legal disciplines. It is necessary to recognize the law clinic as the subject of the provision of free legal aid.
