Залучення спеціаліста до огляду при розслідуванні розкрадань майна шляхом зловживання службовим становищем

Abstract

У статті розглянуті елементи криміналістичної характеристики привласнення, розтрати, заволодіння майном шляхом зловживання службової особи своїм службовим становищем та використання окремих видів спеціальних знань під час огляду у кримінальних провадженнях. The article considers the elements of forensic characterization of misappropriation, embezzlement, seizure of property through abuse of office by an official and the use of certain types of special knowledge during the investigative review in criminal proceedings. The purpose of the study is to determine the range of specialists and analyze their functions during inspections in the investigation of misappropriation, misappropriation or seizure of property by abuse of office by an official. Analysis of criminal law and forensic characteristics of this offense, generalization of the main provisions of research, investigative and judicial practice shows that during the inspections in the investigation of criminal offenses under Part 2 of Art. 191 of the Criminal Code of Ukraine, the following special knowledge can be used for the most part: a) forensic knowledge in the field of forensic photography, video recording and sound recording, in the field of forensic tracing and trasology, in the field of technical research of documents, handwriting and copyright; b) special economic knowledge in the field of accounting, tax accounting, financial reporting, pricing; e) special commodity knowledge; f) special automotive and transport and commodity knowledge; g) special construction-technical, land-technical, appraisal-construction, appraisal-land, road-technical knowledge and knowledge of land management; g) special knowledge in the field of information and computer technologies; h) special psychological knowledge. During the investigation of theft through abuse of office by an official, the inspection can be divided into such types as: inspection of the scene, premises, areas, things and documents.
