Розвиток митної системи України в контексті Угоди про асоціацію з ЄС

Abstract

У магістерській кваліфікаційній роботі комплексно досліджено особливості функціонування та становлення митної системи України, в умовах поглиблення європейської інтеграції та політико-економічних викликів сьогодення. Розкрито теоретико-правові засади митної справи, проаналізовано сучасну нормативноправову базу з ретроспективним оглядом її створення та еволюції, що регламентує діяльність митних органів, а також визначено ступінь її відповідності стандартам і вимогам Європейського Союзу. Значну увагу приділено еволюції митної політики України: від етапів формування національної моделі митного регулювання до трансформаційних процесів, які активізувалися після підписання та набрання чинності Угодою про асоціацію між Україною та ЄС. У роботі здійснено оцінку ефективності функціонування митної системи в контексті імплементації положень європейського митного права, зокрема норм Митного кодексу Союзу (Union Customs Code). Окремо розглянуто ключові виклики, що супроводжують процес гармонізації митного законодавства, включаючи інституційні, організаційні, технічні та кадрові аспекти. Проаналізовано актуальні тенденції цифровізації митних процедур, розвиток інституту авторизованих економічних операторів (AEO), впровадження сучасних інформаційних систем та нарощування матеріально технічної бази, що спрямовано на підвищення прозорості та ефективності митного адміністрування. На основі проведених досліджень сформульовано узагальнення теоретичних положень, обґрунтовано аналітичні висновки та запропоновано практичні рекомендації, в межах компетенцій, спрямовані на вдосконалення митної політики та посилення інституційної спроможності митної системи України в умовах її подальшої інтеграції до європейського простору.

This master’s qualification thesis provides a comprehensive examination of the functioning and evolution of Ukraine’s customs system under the conditions of deepening European integration and the political-economic challenges of the present day. The study outlines the theoretical and legal foundations of customs affairs, analyses the current regulatory framework with a retrospective overview of its formation and evolution, which governs the activities of customs authorities, and assesses the degree of its compliance with the standards and requirements of the European Union. Considerable attention is devoted to the evolution of Ukraine’s customs policy: from the stages of forming a national model of customs regulation to the transformational processes that intensified after the signing and entry into force of the EU–Ukraine Association Agreement. The thesis assesses the effectiveness of the customs system in the context of implementing the provisions of European customs law, particularly the norms of the Union Customs Code (UCC). It separately examines the key challenges accompanying the process of harmonizing customs legislation, including institutional, organizational, technical, and human-resource dimensions. The study analyses current trends in the digitalization of customs procedures, the development of the Authorized Economic Operator (AEO) programme, the introduction of modern information systems, and the enhancement of material and technical capacities aimed at improving the transparency and efficiency of customs administration. Based on the conducted research, the thesis formulates generalized theoretical principles, substantiates analytical conclusions, and proposes practical recommendations — within the relevant competencies—aimed at improving customs policy and strengthening the institutional capacity of Ukraine’s customs system in the context of its further integration into the European space.
