Інтерпретації та захист екологічних прав людини: міжнародні стандарти та українські реалії

Abstract

Розкрито актуальність екологічних прав людини у контексті національної та міжнародної правової доктрини. Проаналізовано законодавче забезпечення екологічних прав людини в міжнародному вимірі, відображено гарантії та механізм їх реалізації. Здійснено науково-теоретичне дослідження та аналіз сутності прав громадян на екологічно безпечне навколишнє середовище враховуючи російську військову агресію в Україні. Розкрито широке коло питань, щодо становлення та захисту екологічних прав громадян в Україні під час війни та міжнародних екологічних прав. Досліджено практику ЄСПЛ з питань захисту екологічних прав людини. The article is devoted to environmental human rights, which belong to the fundamental natural rights. We have revealed the relevance of environmental human rights in the context of national and international legal doctrine. Analyzed the legislative provision of environmental human rights, guarantees and the mechanism of their implementation. Carried out a scientific and theoretical study of the essence of citizens' rights to an environmentally safe environment. The article reveals a wide range of issues related to the formation of environmental law in Ukraine and international environmental law. Much attention is paid to the violation of environmental rights of citizens during the Russian military aggression.

The article also examines the formation of international standards in the field of environmental protection, and clarifying their impact on modern environmental legislation of Ukraine. We analyzed the regulations relating to international environmental law, and also the case law of the European Court of Human Rights in the field of nature management.
