Особливості організації діяльності місцевих органів виконавчої влади та органів місцевого самоврядування під час воєнного стану

Abstract

Розглянуто особливості організації діяльності місцевих органів виконавчої влади та органів місцевого самоврядування під час воєнного стану. Зазначено, що введений в дію воєнний стан привів до зміни чинного законодавства та утворення нових тимчасових органів публічної влади та зміни в організації діяльності місцевих органів виконавчої влади та органів місцевого самоврядування. Виокремлено особливості організації діяльності місцевих органів виконавчої влади та органів місцевого самоврядування, до яких належать: особливості утворення та функціонування військових адміністрацій, наділених повноважень, проходження державної служби та служби в органах місцевого самоврядування. Акцентовано увагу на підставах і порядку створення військових адміністрацій населених пунктів. Проаналізовано повноваження військових адміністрацій і зазначено, що військові адміністрації як суб’єкти публічної адміністрації виконують повноваження місцевих органів державної влади та органів місцевого самоврядування, а також повноваження у сфері забезпечення здійснення заходів правового режиму воєнного стану, у сфері оборони, громадської безпеки і порядку, захисту критичної інфраструктури. The article deals with the peculiarities of organization of activity of local executive authorities and local self- government authorities during the martial law. It is noted that martial law, declared on 24 February 2022, led to changes in the current legislation and the emergence of new temporary public authorities, in the organization of activities of local executive authorities and local self-government authorities. The specific peculiarities of the organization of the activities of local executive authorities and local self- government authorities are: peculiarities of the formation and functioning of military administrations, peculiarities of the delegated powers of military administrations, peculiarities of the civil service and service in local self-government authorities. The powers of military administrations are analysed and it is noted that military administrations, as subjects of public administration, fulfil powers of local state authorities and local self-government authorities, as well as powers in the sphere of ensuring the implementation of measures of the military law, in the sphere of defense, public security and order, protection of critical infrastructure. It i also stated that the activities of the military administrations are directed, coordinated and controlled by the Cabinet of Ministers of Ukraine and the General Staff of the Armed Forces of Ukraine, depending on the powers they exercise. Attention is focused on the basis and the procedure of the establishment of military administrations of settlements and it is outlined that the analysis of the issued presidential decrees on the establishment of military administrations of settlements provided an opportunity to draw the conclusion that such military administrations of settlements were formed in those localities where the fighting took place or after the deoccupation of Ukrainian territories.
