Порушення суб’єктивного корпоративного права особи як підстава для захисту права

Abstract

Стаття присвячена дослідженню питання порушення суб’єктивних корпоративних прав особи як підстави для захисту порушеного права .

У даній статті автором робиться спроба розкрити зміст поняття «порушення» корпоративних прав, визначити його характерні ознаки, особливості ефективного захисту порушених корпоративних прав особи.

Автором були опрацьовані наявні наукові характеристики вказаного поняття та його ознак. А також, здійснено аналіз судової практики з питань особливостей порушення корпоративних прав особи та їх захисту.

В результаті дослідження сформовано ряд характерних рис, які притаманні саме порушенню корпоративних прав особи. Та проаналізовано специфічні вимоги до способів захисту порушених корпоративних прав, які мають місце у судовій практиці. The author elaborated the existing scientific characteristics of the specified concept and its features. Also, an analysis of judicial practice was carried out on the specifics of the violation of the corporate rights of a person and their protection.

As a result of the study, a number of characteristic features were formed, which are inherent in the violation of the corporate rights of a person. And the specific requirements for methods of protection of violated corporate rights, which take place in court practice, have been analyzed.
