Усиновлення іноземцями дітей-сиріт з України: нормативно-правовий аспект

Abstract

Розглянуто нормативно-правовий аспект забезпечення процесу усиновлення. Проаналізовано юридичну базу з питань міжнародного усиновлення. Досліджено питання правової природи усиновлення та умов його проведення, норми, що регулюють умови усиновлення, проблеми, що виникають під час здійснення усиновлення. Вказано, що дослідження нормативно-правового регулювання здійснення усиновлення іноземцями дозволяє комплексно оцінити важливість даного питання не лише з боку теорії, але й практики. Тhe article deals with the problem of legal support of the adoption process. Particular attention is drawn to the organizational and legal conditions for social protection of orphans and children deprived of parental care. Served detailed description of the legal aspects of the adoption of Ukrainian orphans by foreigners. The analysis of the legal framework for international adoptions. The problems of the legal nature of adoption and conditions of the rules governing the conditions of adoption, the problems arising in the course of adoption. The need for compliance with the consent of the child for adoption, if it allows its age and state of health. A survey in article analyzes legal regulation allows to complete the adoption appreciate the importance of this problem not only in terms of theory, but practice is an important factor in providing educational support for children orphaned in the process of adoption by foreigners. Ukraine reforming legislation in respect of one of the basic principles of the UN Convention on the Rights of the Child – to ensure the best interests of the child. According to the data contained on the Ministry of Social Policy of Ukraine rate of international adoption in Ukraine annually falling rapidly.
