Місце права на життя в системі прав людини

Abstract

Проаналізовано основні підходи щодо розуміння сутності категорії „життя” у філософському та правовому значенні. З’ясовано проблемні питання, пов’язані із поняттям, структурою, змістом та ознаками права людини на життя, а також визначено місце досліджуваного права в системі прав людини. З’ясовано сутність гарантій реалізації права людини на життя та здійснено їх класифікацію, визначено місце та роль серед гарантій реалізації права людини на життя державних і громадських інституцій. Basic approaches are analyzed in relation to understanding of essence of category of „life” in a philosophical and legal value. The problem questions, related to the concept, structure, maintenance and signs of human right to life, are found out, and also the place of the investigated right is determined in the system of human rights. Essence of guarantees of realization of human right to life is found out and their classification is carried out, the place and role of state and public institutes are determined among the guarantees of realization of human right to life.
