Правовий статус адвоката в адміністративному судочинстві

Abstract

Після аналізу праць видатних дослідників наголошено, що як професійний захисник і представник інтересів клієнта адвокат може брати участь у величезній сфері матеріальних та процесуальних правовідносин, в кожних з яких він має певне коло завдань, прав та обов’язків, що сукупно визначають його правове становище у цих відносинах. Проаналізовано правовий статус адвоката в адміністративному судочинстві, адже він пов’язаний із розв’язанням конфліктів у публічно-правовій сфері. Розглянуто сутність поняття правового статусу, в тому числі адміністративно-правового, а також проаналізовано відповідні норми чинного законодавства, що регулюють інститут адвокатури та порядок здійснення адміністративного судочинства. The article deals with legal status of the lawyer in administrative legal proceedings as an independent participant of the administrative legal proceedings that hashistasks, function sandauthorities. After analyzing the works of famous researcher sit was notedthatas a professional defens ecounsel and legal representative the lawyer can take partin the widerange of financial and procedural relations where he has scope of functions, rights and responsibilities. The functions, rights and responsibilitie sof the lawyer, the most important of which is protection of rights, liberties and legal interests of people, define his place in legal relations. The article analyzes legal place of the lawyer in administrative legal proceedings in terms of arbitration policiesin the publicsp here. The definition of legal and administrative legal status is reviewed together with theexisting statutory regulations in relation to defense attorney sand the procedure of theexecution of the administrative legal proceedings.
