Філософська інтерпретація правового простору як особливої форми соціального простору

Abstract

Розглянуто різні підходи до поняття «соціальний простір», обґрунтовується соціальна природа правового простору, визначається правовий простір як, з одного боку, своєрідна соціальна структура, яка охоплює простір смислів, зв’язаність конкретних гармонізованих або суперечливих правових домагань, а також їх визнання суспільством і державою шляхом встановлення належних законодавчих норм. З іншого боку, як середовище залежностей, відносин та діянь різних правових суб’єктів. Встановлюється, що правовий простір об’єктивно спрямований на забезпечення врівноваженості і стабільності суспільства, законності і правопорядку в державі. In this article is considered different approaches to the concept of «social space», justified the social nature of the legal space. It is determined the legal space, on the one hand, a kind of social structure that covers a space of meaning, connectedness specific harmonized or conflicting legal claims, as well as their recognition of the society and the state by establishing appropriate legislation. On the other hand legal space is the dependence of the medium, and the relationship among the various legal entities. It is established that the legal space of the objective aimed at ensuring the balance and stability of society, law and order in the state. It is advisable to admit that the legal space is a special form of social space, which generally includes not only implemented, but also potential legal claims, are most sensitive to behavior (lawful or unlawful) legal entity, where with the help of the law and other legal measures established stability, rule of law and legality. The concept of legal space form expresses the existence of a higher structural level of society being, is the main support mechanism for social relations and relations of social subjects. The public legal space coordinates plurality of separate legal spaces plurality of active legal entities. Belonging to this space is not only inevitable, but also need each entity that contributes to the acquisition by a person designated position in society. The legal space objective aims to provide balance and stability of society. The legal space is created when a person develops the ability and the need to respect the law as an indispensable regulator of social life, to respect their rights and freedoms.
