Міжнародно-правові аспекти міграційної кризи

Abstract

Розглянуто історичні передумови виникнення міжнародно-правового регулювання міграційних відносин, у тому числі статусу біженців, аналізу міжнародних, у тому числі європейських, нормативних документів цієї сфери. Робиться висновок, що існування достатньо розгалуженої міжнародно-правової системи захисту прав біженців та визначення їх статусу не гарантує вирішення проблем таких осіб. Європейська міграційна криза 2015 р. продемонструвала, що держави Європи не мають змогу вирішити ці питання лише за рахунок надання їм захисту. Це є справа спільних зусиль всього міжнародного співтовариства. Вирішення проблем біженців має не лише економічну та гуманітарну складову, а й більшою мірою залежить від узгодження політичної волі держав. The article examines the historical background of international legal regulation of migration issues, including the status of refugees, the analysis of international, including European, regulations in this area. It is concluded that the existence of quite an extensive international legal system to protect the rights of refugees and determining their status does not guarantee the resolution of their problems. European migration crisis 2015 demonstrated that European countries are not able to solve these problems only by providing them with protection. It is a matter of joint efforts of the international community. It has not only economic and humanitarian component, but also largely depends on the coordination of political will of States.
